We’ve all experienced the death of a loved one and know that it is the most stressful situation a person can go through. When that death is unexpected, it can be even more devastating as there was no time to plan for life in the absence of our loved one. Possibly the most overwhelming of these already challenging situations is when the death of our loved one results from another party’s negligence. There are many circumstances that are considered wrongful death. Vehicle accidents that result from a person’s negligence or medical malpractice are both examples of wrongful death. By definition, wrongful death allows the victim’s family to hold the person responsible liable for the death, and they can file a civil action against that person for damages. It’s important to note is that there is a statute of limitations in the state of New York in cases of wrongful death.  A claim must be filed no more than two years from the time the death occurred.
